Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your use of the Jambah dating app, the jambah.app website, and any related services (together, the “Service”), operated by Jambah (“we”, “us”, “our”).

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy, which explains how we handle your personal information, is part of these Terms.

2. Eligibility

You must be at least 18 years old to use the Service.

By using the Service you confirm that you are at least 18 years old and that you are legally able to enter into these Terms.

The Service is intended for South Sudanese people and friends of the community. You agree to use your real identity and provide accurate, truthful information in your profile.

3. Your account

You are responsible for keeping your login credentials secure and for everything done with your account.

You must provide accurate information and keep it up to date.

One person should maintain one account. Creating multiple or fake accounts is prohibited.

If you believe your account has been compromised, contact support@jambah.app immediately.

4. Acceptable use

You agree not to use the Service to:

— Harass, bully, threaten, defame, or intimidate any person.

— Post content that is illegal, obscene, hateful, discriminatory, or sexually explicit.

— Post content that is not your own, or that you do not have the right to share.

— Attempt to harm minors or engage in any sexual activity with anyone under 18.

— Misrepresent your identity, age, or intent, or create fake profiles.

— Solicit money, scam, defraud, or deceive other users.

— Attempt to access another user’s account or to interfere with the Service, including hacking, scraping, or denial-of-service attacks.

— Use the Service for commercial promotion or spam.

— Share content that infringes anyone’s intellectual property rights.

— Encourage or assist any of the above.

We may remove content and suspend or permanently ban accounts that breach these rules.

5. User content and license

You retain ownership of the content you post on your profile. By posting content, you grant Jambah a non-exclusive, worldwide, royalty-free licence to host, store, display, and use that content solely to operate, improve, and promote the Service.

You represent that your content complies with these Terms and applicable law.

6. Premium services

The Service may offer paid premium features. Prices, features, and payment terms will be shown to you before purchase. Purchases are subject to the applicable payment provider’s terms. Fees may be non-refundable except where required by law.

7. Intellectual property

The Service, including its software, design, logos, and trademarks, is owned by Jambah and its licensors. You may not copy, modify, distribute, sell, or reverse engineer the Service except as expressly permitted by law.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, and we are not responsible for the conduct of other users.

You are responsible for your own interactions with other users and for your personal safety when meeting people you have connected with online. Meet in public places and follow your own judgement.

9. Limitation of liability

To the maximum extent permitted by law, Jambah shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claim arising out of these Terms or the Service shall not exceed the amount you paid to use the Service in the twelve months before the claim, or 100 US dollars, whichever is greater.

10. Termination

You may stop using the Service at any time and delete your account from the app settings or by contacting support@jambah.app.

We may suspend or terminate your account at any time if we reasonably believe you have breached these Terms or if required by law. Upon termination, your account and profile may be removed from the Service.

11. Changes to these Terms

We may update these Terms from time to time. We will update the date at the top of this page and, where appropriate, notify you in the app. Continued use of the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the Republic of South Sudan, without regard to conflict-of-law rules. Any disputes will be subject to the exclusive jurisdiction of the courts of South Sudan.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
